General Terms and Conditions of Sale (GTCS)

These General Terms and Conditions of Sale govern the relationship between consumers purchasing services online and the company QDS Leisure SA, a Swiss corporation, with its registered office at Avenue de la Gare 56, 1920 Martigny, registered in the commercial register under the number IDE CH-436.345.088 and CH-621.3.008.841-9.

1. Definitions

The following terms, when used with a capital letter in these Terms, have the following meanings:

• Buyer: Any individual acting for personal purposes (non-professional) and purchasing a Service to access the Public Baths of Martigny.
• Service: Right of access to the Public Baths of Martigny, in digital or physical form, including entry tickets, subscriptions, and other associated services.
• Terms: These General Terms and Conditions of Sale governing the purchase and use of Services.
• Consumer: Any individual acting for personal purposes, excluding commercial, industrial, artisanal, or liberal activities.
• Public Baths of Martigny: The bathing complex located in Martigny, including all its facilities and services for well-being and relaxation.
• Website: The official website of the Public Baths of Martigny, accessible at Les Bains Publics — Quartier LôDzè | Martigny, Valais.

 

2. Scope of Application

These Terms apply to the sale of Services offered on the Website of the Public Baths of Martigny. They exclusively govern transactions between the Buyer and the Public Baths of Martigny. By placing an order, the Buyer acknowledges having read and accepted these Terms without reservation. Any order placed after the publication of a new version of the Terms implies acceptance of the updated version.

3. Acceptance of the Terms

By confirming the order on the Website, the Buyer confirms having read and accepted all of these Terms. The Buyer agrees to abide by the provisions of the Terms when using the services of the Public Baths of Martigny.

4. Modifications to the Terms

The Public Baths of Martigny reserve the right to modify these Terms at any time, particularly due to legal or technical developments. The new version of the Terms will be published on the Website and will take effect as soon as it is online. Each order placed after the publication of the new Terms implies acceptance of those Terms.

5. Purchase of Services

To purchase one or more Services (for oneself or for a third party), the Buyer must log into the Website and provide the required information to complete the order. By confirming the order, the Buyer agrees to purchase the selected products in accordance with these Terms. Once the transaction is confirmed, a purchase confirmation will be sent by email.

Orders are considered firm and final only after confirmation by email from the Public Baths of Martigny. They reserve the right to refuse an order, particularly in case of insolvency of the Buyer.

The data recorded by the Public Baths of Martigny is proof of the order or transaction, and payment system data serves as proof of financial transactions.

6. Price

The price of the Services, expressed in Swiss francs and including all taxes, is the one indicated on the Website at the time of the order. The price may change in case of variation in applicable taxes. The Public Baths of Martigny reserve the right to modify their prices at any time and cancel any order in case of price, wording, or calculation error.

7. Opening Hours

The Public Baths of Martigny are open to external customers from Wednesday to Sunday, from 7:00 AM to 10:00 PM and friday until 11:30 PM. The establishment reserves the right to change these hours without notice for maintenance, safety, or other reasons.

8. Access and Restrictions

Access to the Baths is reserved for individuals aged 18 and over. The Public Baths of Martigny reserve the right to refuse access to anyone not complying with the terms of use or not wearing appropriate clothing and equipment (e.g., swimwear, towel, etc.).

9. Behavior and Safety Rules

Users of the Public Baths agree to follow these rules:

• The use of the baths is at the users' own risk.
• The Public Baths of Martigny disclaim any liability for accidents or personal injuries occurring within the facilities, unless due to their negligence.
• Running, shouting, smoking, being under the influence of drugs or alcohol, or bringing unauthorized items into the baths is prohibited.
• Users must respect the tranquility of other customers and follow the instructions of maintenance and security staff.

 

10. Liability of the Public Baths of Martigny

The Public Baths of Martigny are committed to maintaining the facilities in an optimal state of cleanliness and safety. In case of technical failure or temporary closure for maintenance, customers will be informed and may request a refund or rescheduling of their reservation, as appropriate.

11. Payment Methods

The price of the Services must be paid in full at the time of purchase, using the payment methods available on the Website.

12. Delivery of the Service

The Service will be sent by email to the address provided by the Buyer at the time of purchase.

13. Modification, Exchange, and Refund

Services, even if unused, are neither modifiable, exchangeable, nor refundable.

14. Cancellation Policy

• Free Cancellation: The Buyer can cancel a reservation without charge up to 24 hours before the scheduled service time.
• Late Cancellation: If cancellation occurs less than 24 hours before the service, the full price of the Service will be due. If the Public Baths of Martigny are unable to provide the reserved service due to circumstances beyond their control, a full refund will be made. The establishment also reserves the right to cancel a service due to inappropriate, disrespectful, or aggressive behavior by the customer, without refund or compensation.

15. Liability

The Public Baths of Martigny strive to provide high-quality services but disclaim any liability for delays or disruptions caused by events beyond their control.

16. Effective Date of the Terms

These Terms apply to any order placed after February 26, 2025.

17. Modifications to the Terms

The Public Baths of Martigny reserve the right to modify the Terms, including the prices of Services, at any time. Modifications will take effect on the date indicated in the updated Terms.

18. Processing of Personal Data

The Buyer must verify the accuracy and completeness of the information provided during registration on the Website. Any changes to address or contact details must be reported to the Public Baths of Martigny.

Personal data collected is processed in accordance with the Federal Data Protection Act.

19. Disclaimer of Liability

The Public Baths of Martigny disclaim any liability concerning information viewed on its website or in its marketing emails, unless such information comes directly from the establishment. Information on the Website may be changed at any time, and its use is the responsibility of the users.

21. Governing Law

These Terms are governed by Swiss law.
